What is negligence

The plain English definition and the legal definition of negligence are quite different.  The origin of the legal term dates back to a famous case where a woman drank a drink with a snail in it.  The court determined that the maker of the drink had a ’special relationship’ with the customer and by not making sure that bottle was free from containments, the maker had failed to fulfil the standards expected in that ’special relationship’.

Whilst the law has developed considerably since that case, the principles are tentatively the same.  The law now uses the term ‘duty of care’ to denote a ’special relationship’ between two persons or groups and asks whether A) there is such a duty given the circumstances, B) whether that duty has been fulfilled to a reasonable standard or not (’breach’) and C) whether it is fair, just and reasonable to impose a duty.
