What is involved in a general property transaction
The simple answer is no two transactions are alike. Whilst houses and flats can appear physically similar on the surface, underneath the bricks and mortars a wide variety of property rights can exist, which affects the transaction process. For instance, it could be the case that historical rights of way are attached to one property, whilst they bear no relation to the adjacent property.
However, there is a definitive pattern to most transactions. In the first instance, an offer will be made, which if accepted will naturally lead to contracts being drafted and negotiated. At the point at which contracts are exchanged, ’searches’ are carried out which reveal further information regarding to the property before any commitment to buy is made. Following the exchange of contracts and the payment of a deposit (usually around 10% of the value of the property), a completion date will be agreed on, where monies are exchanged the the buyer is given possession of the property.

Transactions involving lenders
The majority of land and property purchases are financed by mortgage lenders to some extent or another. Where a lender is involved, they will require certain things are undertaken to ensure the risk they take on is at acceptable levels. They will request local and sewage and drainage searches, as a minimum, are carried out. Where there are obscure legal rights in the title, the lender as a matter of course may require indemnity insurance is taken out or the matter is legally resolved.
